First of all, when I say all attorneys are appointed and paid for by the government, a non-governmental, independent outside organization actually provides the attorneys, but the government covers the cost. That way, both sides of any judicial proceeding have equally qualified representation. Furthermore, the concept of jury by your peers has inherent weaknesses. Let me give you just one example to illustrate my point. In the O.J. Simpson murder trial, the defense had an oratorical genius in Johnnie ("If the glove doesn't fit, you must acquit!") Cochran. If I butcher someone (and get caught) sure as shit I'll want the best my money can buy...I'm gonna look for the guy or gal who can, as you say, "appeal to the emotional prejudices of a man-on-the-street jury".
You want justice; I want 'out'.
I'm not interested in "equally qualified representation"; I want my defense to trounce the prosecution by whatever means necessary.
Your goal is laudable (equal justice under the law) but (especially if I'm the accused [especially if I'm guilty]) that ain't my bag.
