Very tough enforcement of formal schooling in Germany

I must say I was rather surprised by this news. I considered Germany one of the most liberal countries in Europe (relatively speaking), but must say this news has changed my perspective some. Getting fined or serving jail-time for home-schooling seems very authoritarian and overly tough, not to mention the even worse case they mention here that people might even had their children taken away from them O.o
I like the concept of public schools but even I realize that you can't just force it down the throat of people or having such severe punishment if they refuse.
