As a mortician I know this is a controversial issue, however I feel it needs to be discussed.

After death we are legally allowed to leave our possessions to our loved ones, this includes property and money. We are also allowed to donate our organs for use by other humans, as well as for medical science. Why are we not permitted to donate/sell our corpse for the sexual gratification of necrophiliacs?

We live in a secular society in which Church and state are separate, therefore religion cannot be used to justify current laws regarding necrophilia.

Necrophilia poses no great risk to ones health. Also regular sex between the living can result in AIDS and other STDs.

This being the case what are the legal justifications for the criminalization of necrophilia?

There is none. The majority of people find it disgusting, so they ban it. That's how democracy work, the majority of people imposes their views on the minority.

I just threw up in my throat! I think you should get out more! But respect to you for providing a service which the majority of people would find awkward and morbid, which is an illogical squeamish and lazy attitude, because everything dies, and death is merely a cyclic fact of life at its end, and someone has to provide a burial.
I think it irrelevent that regular sex has consequences which may result in deseases, but rather that regular sex creates relationships and causes the survival of the species. It's very simple really, don't have relationships unless it is to reproduce, therefore having sex with corpses is futile and non-productive.
If one is a political or metaphysical nihilist who questions every law, well, Swift suggested the cannabilism of deceased Irish children during the potato famine, but this was a satirical critique of the imbalances of class privilege within English society, with aristocracy as targets.
There is no legal justification or common sense desire for such sexual unions with the dead, it goes beyond moral legislation, it's just a bad tendency, it's crazy to even think of this, and criminality has nothing to do with its illegality, it's about taste and aesthetics, about being a person who is fun to have around , it's about pillow talk, mutual exchanges of affection, I'm sorry if I sound so authoritarian, but you'll find that regardless of democracy, 100% of people are not interested in necrophilia, and those that are are psychopaths or members of an inverted christian based devil worshipping cult.

If I understand you correctly, you introduce the following arguments.

Premise: sex is meant for relationships and reproduction.
Conclusion: it is wrong to have sex that doesn't satisfy this purpose.

Premise: almost nobody is interested in necrophilia.
Conclusion: it must be wrong.

In both arguments, I don't see how the conclusion follows from the premise. I also doubt that all necrophiliacs are either psychopaths or devil worshipers.

My apologies then, I must have misunderstood. But based on your conclusion that necrophilia is "unbiological", how can you defend its illegality? Should things that are not in accordance with our biological nature be illegal?

I can't see any reasons why a necrophiliac wouldn't have any values. He could have more values than average, just not the value "you can't have sex with dead people".

Good point about the state. It sends you to jail for victim-less crimes like necrophilia while the state itself is committing real harm to people.

Speaking about victims, in case of necrophilia the relatives could be victims when they don't agree with the sex act, especially if they are religious. So I change my position: it should only be legal when the deceased has no relatives, his relatives agree or if he has agreed by himself before his death.

Sure, values are had by all, I should have been more specific, but this then opens up an ethical can of worms, aesthetics included. But this whole topic has convinced me to be cremated, even in death I would feel I had been violated, I don't know where this comes from, I just believe in some dignity for a corpse, relatives or not. And I would make an attractive corpse if I was to die tomorrow, no,,,I shall be cremated!!

The human body is the responsibility of the family of the deceased.
My body is mine - I hope you agree. That does not mean that I suddenly have to offer it to you for your sexual gratification. I hope you would agree that I ought to have a say what happens to it after I die?

I can't imagine there are a queue of people lining up for you to fuck them when they die.

I am assuming the dead person specifies that their corpse can be used by necrophiliacs in their will. It would be unjustified for the family to prevent this happening, after all someone may be a different religion to their parents.
