The real issue revolves around the point at which police may legitimately disperse (or violently oppose) protests which are riots.

This however is what your concern seems to be about.

The State always seems to push somewhat too far against protest, but simultaneously protestors these days very much puch the limits of what is legitimate. In other instances the State does not show necessary and needed opposition.

Yes. They are done without consulatation with the democratic institutions; they are done without specific mandate; there is no scrutiny to them.
The fat bloke signs a bit of paper and the order comes into effect.
The Executuve Order is the essence of the tyrrant.
They are edicts; dictats.
They can be trivial, stuff too petty to bother the house and senate, but Trump made some pretty draconian measures, like defunding legal abortion; fucking off the Dakota and slamming through their objections to the pipline; enforcing transgender registration in the forces.
You might agree or disagree with these measures, but should they not have been discussed with the democratic institutions??

If you look at Obama's activities many relate to exta-legal conditions in Guantanamo Bay, where Internationally agreed human right abuses were common and the legislature had no direct jusisdiction so directions had to come from the White House.

A Short History

Washington and his successors as president have issued thousands of executive orders. The State Department began numbering them in 1907, working from files going back to 1862. The Federal Register Act of 1936 built on that effort. Today, the official number is close to 14,000.

Even so, approximately 1,500 unnumbered executive orders also have been compiled, according to the American Presidency Project, which notes that there may be as many as 50,000 unnumbered orders.

Washington issued a total of eight executive orders in his two terms, according to the project’s data, while John Adams, James Madison, and James Monroe all issued only one. Presidents who issued the least also include Thomas Jefferson (four) and John Quincy Adams (three).

Lincoln, with 48 executive orders, was the first to approach 50. Ulysses Grant with 217 was the first to break 200, and he held that record until Theodore Roosevelt came along (1,081). Other leading issuers of executive orders include Woodrow Wilson (1,803), Calvin Coolidge (1,203), Herbert Hoover (968), and Harry Truman (907).

Under our (United States) system of government, the president’s authority to issue such orders (or to engage in any other form of unilateral executive action) must come from the Constitution or federal law. Put another way, an executive order can be used to execute a power the commander in chief already has. It can’t be used to give the presidency new powers.

He should use a Leftist tactic, should he be elected. He should do any damn thing he wants and let courts sort it out, long after its intended effect.
