I think the main argument for retaining them is that they offer protection against a compromised judiciary, taking its orders from a corrupt regime. Not a perfect protection, but certainly better than nothing.

The main argument for abolishing them is the one the government have used, namely, efficiency. Also, juries can very occasionally go completely off the rails. There was apparently a case where a jury used a ouija board to contact a murder victim, for example, which, in my opinion, shows initiative, more than anything else.

Apparently the overlooked difference in play here is that juries don't ever provide any reasoning for their decisions which are covered by secrecy rules, but if magistrates or judges issue a verdict, they always provide the reasons. It seems this means that every case will be open for appeal because of this, whereas for jury trials only a minority are.

I have sat on two criminal juries. In both cases the defendants were blatantly not guilt and the accusers were actually attempting to cover up some misdemeanour of their own. In both cases we nevertheless had to sit through a debate about whether the police would prosecute the guy if he wasn't guilty of something or other.

F. Lee Bailey, the famous U.S. defense attorney, got his start in the legal profession in the military. MIlitary trials involve a triumvirate of judges, all officers. In the book I read, Bailey claimed the verdicts were more reasonable and evidence-based in the military than in civilian jury trials, because the judges were smarter and better educated than the jurors. Of course there are other considerations.

I think all of you are full of shit about jury selection. How can a government ask any jury to make judgments, when the governments own educational system can not even teach them judgment, in fact, it will refuse to teach children judgment.

Women who have been raped are known for getting fair treatment in muslim countries, with the legal system coming down hard on the rapists. How dare you suggest that muslims are not supportive of women's rights!
