Can a service provider legitimately claim to have no responsibility for content?

Depends on what the provider offers in the first place.
If A sez 'we not only provide the conduit but are also the filter' you're gonna have certain expectations.
If Z sez 'we only provide the conduit, what gets conducted ain't on us' you'll have a different set of expectations.
